CAN-SPAM & Commercial Email Policy

The CAN-SPAM Act generally regulates commercial email, including business-to-business email, and does not create a general federal opt-in requirement. State privacy, unfair-practice, professional, and sector rules may impose additional duties. A public-record email address does not mean the owner requested marketing.


For every commercial email, Customer must use accurate routing, From, To, domain, and reply-to information; use a subject line that is not deceptive; identify the message as advertising where required; include the sender's valid physical postal address; provide a clear, conspicuous, functional opt-out method that is easy to use and does not require payment, login, or unnecessary information; honor opt-outs within the legally required period, no later than 10 business days under CAN-SPAM, and keep the mechanism available for at least the required period; maintain suppression so opted-out addresses are not mailed again or transferred for marketing, except to a provider helping comply; monitor agencies, affiliates, and vendors, because outsourcing does not eliminate responsibility; and preserve send, template, sender-identity, suppression, and vendor records.


Customer may not use harvested addresses obtained unlawfully, dictionary attacks, misleading headers, deceptive subject lines, or relays without permission, and may not treat a Vortoc Lead as evidence of opt-in. For divorce, probate, or distress-related events, subject lines must not publicly expose the event or imply a confidential relationship.
